Paragraph 156 trong phán quyết của PCA về jurisdiction vụ Philippines vs China cực kỳ quan trọng. Nói vắn tắt toà cho rằng tranh chấp liên quan đến quyền lợi (entitlement) trên biển khác với tranh chấp liên quan đến ranh giới biển (delimitation). Hai quốc gia có thể có tranh chấp về entitlement mặc dù không hề có tranh chấp về delimitation. Toà dưa ra ví dụ cụ thể về tranh chấp entitlement trên vùng biển quốc tế (high sea) mà theo UNCLOS không thuộc chủ quyền nước nào cả.

Mặc dù không đề cập trực tiếp đến đường 9 đoạn, paragraph này gần như khẳng định jurisdiction của toà về tranh chấp giữa Philippines (và các nước khác bao gồm cả các nước trong khu vực lẫn Mỹ, Úc, Nhật...) với TQ trên vùng biển mà TQ cho rằng họ có "historic rights" bên ngoài EEZ của họ. Ví dụ việc TQ giành toàn bộ quyền quản lý đánh cá trong vùng 9 đoạn rõ ràng là vấn đề entitlement, cho nên bất kể TQ đã opt-out khỏi nghĩa vụ bắt buộc phân xử về delimitation thì toà vẫn có quyền phán quyết liệu quyền quản lý đánh cá đó có đúng hay không vì đây là 2 vấn đề riêng biệt.

"In particular, the Tribunal considers that a dispute concerning the existence of an entitlement to maritime zones is distinct from a dispute concerning the delimitation of those zones in an area where the entitlements of parties overlap. While fixing the extent of parties’ entitlements and the area in which they overlap will commonly be one of the first matters to be addressed in the delimitation of a maritime boundary, it is nevertheless a distinct issue. A maritime boundary may be delimited only between States with opposite or adjacent coasts and overlapping entitlements. In contrast, a dispute over claimed entitlements may exist even without overlap, where—for instance—a State claims maritime zones in an area understood by other States to form part of the high seas or the Area for the purposes of the Convention."
